Antitrust enforcement is being reshaped by technology, and the risks increasingly reach companies far beyond Big Tech. Darin Sands and Tiffany Lee of Bradley Bernstein Sands LLP will provide a practical refresher on the antitrust fundamentals, then dive into the issues driving today’s enforcement landscape: algorithmic price-fixing and the DOJ/FTC’s position that “algorithms don’t immunize price fixing,” the wave of hub-and-spoke claims targeting shared pricing software (RealPage and beyond), the landmark United States v. Google search decision and its remedies, and what the ruling means for companies that depend on — or compete with — dominant platforms. They’ll also touch on labor-market antitrust risks, including no-poach agreements and non-competes, and new state-level merger reporting requirements in Washington, Colorado, and California. The talk will focus on practical takeaways: how to spot algorithmic pricing risk in a company’s vendor stack, questions to ask about platform conduct, and compliance steps your or your client’s business teams can act on now.

Darin Sands
Founding Partner, Bradley Bernstein Sands LLP
Darin Sands is a founding partner of Bradley Bernstein Sands LLP based in Portland, where he represents companies in antitrust and complex commercial litigation and investigations. His antitrust experience includes MDL class actions and DOJ criminal investigations arising from alleged price fixing in the auto parts, CRT, and LCD industries, and his cartel defense work was recognized with Global Competition Review’s Litigation of the Year—Cartel Defense Award (2019). Darin is a former chair of both the Federal Bar Association’s Antitrust and Trade Regulation Section and the Oregon State Bar’s Antitrust and Trade Regulation Section, and co-authored the DOJ price-fixing chapter of the ABA’s International Criminal Cartel Handbook. He is a member of the California, Oregon, and Washington bars.

Tiffany Lee
Attorney, Bradley Bernstein Sands LLP
Tiffany Lee is an attorney in BBS’s Seattle office with deep experience in antitrust, consumer protection, privacy, and data security law, drawing on both government and private-sector experience. She began her career at the Federal Trade Commission, where she worked in the Anti-Competitive Practices Division and the Office of International Affairs, and later served as an Assistant Attorney General for the State of Washington, leading high-profile investigations and serving as lead counsel in numerous multistate matters. In private practice — including at Wilson Sonsini in New York and California and, most recently, Perkins Coie — Tiffany has represented both plaintiffs and defendants in complex antitrust disputes, including multistate investigations, multidistrict litigation, global monopolization and cartel cases, and competitor actions, defending leading technology, gaming, manufacturing, and media companies across all phases of litigation, from discovery through appeal.
