EU Regulation of Big (and Not-So-Big) Tech: The Digital Services Act and Digital Markets Act

The EU’s Digital Services Act and Digital Markets Act are flagship projects within the EU’s digital strategy. They aim to provide a safe digital environment for users free from illegal content, enhance transparency and accountability of service providers, strengthen the protection of fundamental European and consumer rights, and establish a level playing field to foster innovation, growth and competitiveness in the EU and elsewhere. In doing so, they impose significant compliance requirements and have wide-ranging impacts on digital businesses providing services to users in the EU. Both regulations are backed by substantial enforcement powers and sanctions—violations could result in considerable fines—and enforcement has already begun. Join the Technology Law Section to discuss (i) the services and undertakings in-scope of both of these regulations, (ii) the obligations they impose on in-scope services and undertakings, and (iii) their knock-on effects on other players within the digital services ecosystem.

 

Speaker Bios

Xuyang Zhu

Xuyang is a Partner in Taylor Wessing’s Technology IP and Information team in London. She advises clients in the technology and media sectors on the exploitation and enforcement of IP rights, covering transactions, product counseling and other advisory matters, disputes and litigation, digital content regulation, monetisation, and the intersection between IP and competition law. Xuyang is one of the firm’s leading experts on content regulation and online safety issues. She advises many of the firm’s online intermediary clients on the Digital Services Act, Online Safety Act, related tech and content regulation, and intermediary liability matters.

 

Dr. Stefan Horn

Stefan is a Partner in Taylor Wessing’s Competition, EU & Trade team in Hamburg. He advises on all questions of EU and German competition law. Stefan’s main focus is on advising on stand-alone/follow-on civil competition law proceedings, in particular cartel damage claims. A further focus of his practice is advising on competition law issues related to the digitalization of the economy, including advice on the Digital Markets Act. Furthermore, Stefan has in-depth knowledge and experience in the application of competition law in the energy, automotive, chemical, and sports sector.
